Warranty
In the United States, Canada, and Mexico, Herman Miller, Inc., ("Company") warrants its products to be free from defects in material and workmanship from the date of initial delivery for the applicable warranty period specified below, when the products are installed and used in accordance with the Company's published instructions. The Company's warranty extends only to original purchasers acquiring new products directly from the Company, its authorized dealers, or others specifically authorized by the Company to act as resellers of its products. Companies purchasing products for out-of-office use by their employees are authorized to pass this warranty on to such employees.
Natural variations occurring in wood, veneer, marble, and leather shall not be considered defects- and the Company does not guarantee the colorfastness or matching of the colors, grains, or textures of such materials. No warranty is made with respect to nonstandard materials selected by and used at the request of the customer.
A one-year warranty period (for labor and materials) applies to all products.
An extended warranty (for replacement of materials only) applies to the following products manufactured and sold after June 5, 1995, which bear a label confirming the date of manufacture. The following periods assume unlimited, three-shift usage of the products; for Home Office products, period assumes daily, single-shift usage.
Textiles, veneers, and other finishes and coverings are warranted separately. See Finishes and Coverings listed below.
Seating Products
12 years Structural components, including frames, shells, and bases
12 years Operating mechanisms including, but not limited to, tilts, adjustable arms, pneumatic cylinders, Pellicle® suspensions for Aeron® chairs, casters, and glides.
Finishes and Coverings
3 years Veneers, laminates, surface finishes, textiles, vinyls, leathers, and othercovering materials (for Workmanship only).
The Company’s obligation and the purchaser’s remedy pursuant to the foregoing warranty are limited as follows: to repair or replace, at the Company’s option, FOB the Company’s plant, products which prove to be defective within the first year of the warranty period and to furnish necessary repair parts for products which proved to be defective within the remainder of the extended warranty period. Defective products must be returned to the Company; products will be returned to the purchaser at the Company’s expense. Purchaser may be required to establish that the products were installed according to the Company’s specifications and that the claim is within the warranty period by producing the invoice for the products or such other evidence as may be reasonably satisfactory to the Company.
TO THE EXTENT ALLOWED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THESE WRITTEN WARRANTIES.
The Company shall not be liable for loss of time, inconvenience, commercial loss, incidental or consequential damages.
Some states or provinces do not allow limitations on how long an implied warranty lasts or allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you (the purchaser).
This warranty gives you specific legal rights, and you (the purchaser) may also have other rights which vary form state to state or province to province.
